Trial Win for William D. Yoquinto in Medical Malpractice and Wrongful Death Action


Bill Yoquinto successfully defended his clients, a local physicians’ group, one of its physicians, and one of its nurse practitioners, at a trial held in Albany County Supreme Court before the Hon. Roger McDonough.

Mr. Yoquinto’s clients and a separately represented physician were sued for medical malpractice and wrongful death of the plaintiff’s decedent as the result of alleged failure to timely diagnose and treat the decedent’s rectal cancer.

Mr. Yoquinto presented a defense arguing that the defendants provided medical care consistent with good and accepted practice and were not guilty of medical malpractice; that his clients timely and appropriately evaluated the decedent’s complaints; that his clients ordered appropriate testing and provided appropriate medical care to the decedent including a referral to the co-defendant specialist; that at no point during the time the decedent was treated by his clients did the decedent make any complaint indicative of rectal cancer; that there was no delay, failure to diagnose, or deviation from standard of care in the defendants’ medical treatment of the decedent. The defense presented testimony of the defendants, as well as fact witnesses, and expert witnesses in oncology and internal medicine whose testimony supported the defense’s argument.

Trial was concluded with a jury verdict of No Cause of Action in favor of all defendants.
