Trial Win for John T. Maloney in Radiology and Urogynecology Action

John T. Maloney successfully defended his clients, a local radiologist and her radiology practice, in a medical malpractice trial held in Albany County Supreme Court before the Honorable Kimberly O’Connor.
Mr. Maloney’s clients and several other physicians were sued for medical malpractice by the plaintiff, a 42 year old married mother of two children, who claimed that she suffered permanent injury due to the alleged medical negligence of the defendants.
Plaintiff claimed that following the birth of her second child, she suffered from gas incontinence. She was referred by her doctor for an outside consultation and was seen by the co-defendant surgeon, who was separately represented in this action. Plaintiff underwent an anterior anal sphincteroplasty and perineorrhaphy to repair a disrupted anterior anal sphincter and disrupted vaginal outlet.
Thereafter, the plaintiff was sent by her surgeon for a CT scan of her pelvis due to a clinical history of mass in the right gluteal area. Her CT scan was reviewed and interpreted by Mr. Maloney’s client, a radiologist, who found mild post-operative inflammation and recto vaginal fistula which could not be excluded and clinical correlation is necessary.
The plaintiff subsequently underwent treatment and several surgical procedures by a non-party colorectal surgeon. She alleged permanent damage due to the negligence of the defendant physicians, who she claimed did not timely or properly diagnose or treat her abscess, causing permanent incontinence and defection issues.
Jury trial was concluded on November 30, 2014 with a verdict of No Cause for Action in favor of both of Mr. Maloney’s clients. The jury returned a verdict of $1.75 million dollars against the co-defendant physicians.
