Trial Win for Adam H. Cooper in Medical Malpractice Action


Adam H. Cooper successfully defended his client, an Albany-area family practitioner, in a two-week medical malpractice trial in Albany County Supreme Court before the Honorable Roger D. McDonough.

Mr. Cooper’s client, together with two Albany-area hospitals and its Emergency Medicine providers, and two orthopaedic surgeons, was sued for negligence and medical malpractice by a plaintiff who suffered from compartment syndrome of the left leg.  Specifically, the plaintiff claimed that the defendants failed to timely diagnose and treat his complaints of left leg pain, thereby causing the manifestation of compartment syndrome in his leg.

Mr. Cooper argued that his client’s diagnosis and treatment of the plaintiff, based upon the history and onset of the plaintiff’s symptoms, was appropriate, reasonable, and within the accepted standards of medical care for a family practitioner.  Mr. Cooper produced an expert medical witness who testified consistently with this defense.

At the conclusion of a two-week trial, the jury returned a verdict of No Cause on behalf of all defendants, finding that the plaintiff did not present any proof that the defendants departed from accepted standards of medical care in their treatment of the plaintiff and, therefore, there was no negligence or medical malpractice committed by the defendants.
