Mackenzie C. Monaco Speaks to the Retail, Restaurant & Hospitality Industries on Drug and Alcohol Testing in the Workplace

On February 7, 2019, Mackenzie C. Monaco spoke to members of the retail, restaurant and hospitality industries at the 2019 Claims and Litigation Management Alliance (CLM) Retail, Restaurant & Hospitality Conference in Grapevine, TX.
Mackenzie’s panel spoke on “Drug and Alcohol Testing in the Workplace: The Messy Process of Ensuring a Clean and Sober Workforce” and included members of the restaurant and hospitality industries. Mackenzie and her fellow panelists addressed employers’ concerns with the increasing legalization of marijuana, the epidemic level of abuse of prescription drugs, how those issues affect the workplace, and when employers can (and cannot) legally test employees. The panel provided practical legal advice for employers, including reviewing and revising workplace policies, consideration of special circumstances such as safety-sensitive positions, handling Americans with Disabilities Act (ADA) accommodations, and the use of employee assistance programs.
