Motion Success for Jonathan E. Hansen on Behalf of Retailer

A plaintiff brought suit in Warren County Supreme Court against a local supermarket for personal injuries she allegedly sustained when she caught the heel of her shoe in a wire mesh bread rack at the deli counter of the store. Attorney Jonathan Hansen represented the defendant supermarket in the action.
The plaintiff’s lawsuit alleged that the store was negligent in placing the bread rack in front of the deli counter as patrons, such as the plaintiff, could not safely reach their deli order on the counter without coming into contact with the bread rack.
Mr. Hansen moved the Court for summary judgment arguing that the store maintained its premises in a reasonably safe condition and that the store display was open and obvious and not inherently dangerous, as a matter of law. The trial court agreed with Mr. Hansen’s argument and granted his Motion, dismissing the case against his client.
