Jessica A. Desany joined A.M. Best for an Insurance Law Podcast, presenting on the topic of insurance coverage matters in New York State, including underinsured insurance developments impacting the insurance industry. Mrs. Desany spoke specifically on SUM Insurance (Supplemental Uninsured or Underinsured Motorist Insurance) in New York State and recent developments and interpretations of SUM Endorsements by New York State courts. She also discussed this year’s legislative changes to New York State’s “no prejudice” rule when a carrier disclaims coverage to an insured based upon the insured’s late notice of a claim or suit, and how this rule was previously changed through case law for SUM Insurance matters.
