Jessica A. Desany and James A. Resila Speak at NYSBA CLE Seminar

Jessica A. Desany and James A. Resila recently presented at the 2009 General Auto Liability Seminar presented by the Torts, Insurance and Compensation Law Section of the New York State Bar Association and the Committee on Continuing Legal Education. The program was designed to familiarize attorneys with the intricacies of automobile liability through an overview of the latest developments and trends in automobile tort law, while providing necessary Continuing Legal Education (CLE) credits to legal practitioners.

Mrs. Desany began the program with her discussion on developments in Uninsured, Supplemental Uninsured, and No-Fault law within New York State. After providing a practical guideline for addressing commonly-experienced issues when confronted with a possible automobile liability tort claim, Ms. Desany explained developments in this area of the New York State’s Insurance Law as they affect claimants and insurance carriers.

Mr. Resila presented an update and review on the “Serious Injury Threshold” of New York State Insurance Law, explaining how the base criteria of injury and damages necessary to allow a claimant to pursue an automobile liability tort claim in New York State has both expanded and contracted through common law interpretation of the pertinent statute.

Jessica A. Desany concentrates her practice in the areas of civil litigation, including actions defending claims of personal injury, premises liability, and construction work-site injuries under New York State’s Labor Law. She also has an active practice in commercial real estate matters, provides clients with insurance coverage analysis, and litigates coverage disputes.

James A. Resila focuses his practice on the defense of municipalities in federal civil rights cases, as well as medical malpractice and negligence defense.
