The Appellate Division, Third Department, recently modified an Order of the Saratoga County Supreme Court which denied a motion for summary judgment made by Carter Conboy on behalf of the defendant in a case involving a dispute between the parties to a commercial real estate lease. On appeal, if Edward M. Connell successfully argued that four of the plaintiff’s five claims in the lawsuit lacked merit as a matter of law and should have been dismissed when the defendant originally requested summary judgment. The plaintiff’s remaining claim was remitted to the Supreme Court, County of Saratoga, for further proceedings.
