Directors Terence S. Hannigan and James A. Resila Obtain Discontinuance of Civil Rights Case

Directors Terence S. Hannigan and James A. Resila obtained a discontinuance at trial in favor of their clients in United States District Court on September 9, 2010.  

The plaintiff, a former volunteer firefighter, claimed that Mr. Hannigan and Mr. Resila’s clients, a volunteer fire company and 15 of its members, violated his First Amendment rights under 42 USC Section 1983 when he was placed on administrative leave.  The plaintiff claimed that the defendants retaliated against him for reports he made to state and federal agencies regarding safety issues he claimed existed at the fire company.  

At trial, the plaintiff agreed to discontinue against Mr. Hannigan and Mr. Resila’s clients after concluding his case. 

Terence S. Hannigan’s practice concentrates primarily in the field of civil litigation.  Additionally, as a New York State Emergency Medical Technician and Volunteer Firefighter, his practice also includes litigation and regulatory matters involving EMS providers, fire departments, municipalities, and hospitals.  

James A. Resila’s practice focuses on the defense of medical and dental malpractice and general negligence cases, as well as the defense of municipalities in federal civil rights actions.
