Director James A. Resila Obtains Dismissal of Breach of Confidentiality Claim

Director James A. Resila obtained a favorable dismissal on behalf of his client, an international metals manufacturer. 

The plaintiff, a scrap management and consulting company, claimed that Mr. Resila’s client breached a confidentiality agreement by disclosing to plaintiff’s competitors the prices the plaintiff was willing to pay for scrap metal and the markets in which the plaintiff operated.   

The case had previously been dismissed by United States District Court Judge David N. Hurd , on motion by Mr. Resila.  The plaintiff appealed the dismissal to the United States Court of Appeals for the Second Circuit.  The Second Circuit affirmed the lower court’s ruling, finding there was no credible evidence to support plaintiff’s claim that any confidentiality agreement between the parties was breached.
