Attorney Alaina K. Laferriere obtained summary judgment in Schenectady County Supreme Court on behalf of her clients, the owner and operator of a motor vehicle. The personal injury action involved a 96 year old woman who alleged she sustained a significant head injury and dementia after being struck by a vehicle owned and operated by Ms. Laferriere’s clients. The Court found that the plaintiff did not suffer a serious injury within the definition of Insurance Law §5102(d) and granted summary judgment, dismissing the plaintiff’s case.
