William J. Decaire Analysis Featured in Publication of Upstate New York Chapter of RIMS
William J. Decaire's analysis of the recent New York State Court of Appeals case, Kassis v. The Ohio Casualty Insurance Company, was recently featured in the August 2009 Newsletter for the Upstate New York Chapter of the Risk and Insurance Management Society, Inc. ("RIMS"). Mr. Decaire analyzed how the Kassis case highlighted the potential pitfalls of a business relying on a third-party to obtain its liability insurance and the adverse impact of a lease agreement which does not properly protect the interests of that business when it later seeks to enforce a contract clause which seemingly requires the other party to defend and indemnify the business, as in an "insured contract".
