Kathleen McCaffrey Baynes Obtains Defense Verdict in Medical Malpractice Trial
Kathleen McCaffrey Baynes obtained a defense verdict in a medical malpractice trial in the Supreme Court in Ulster County, New York. The board-certified general surgeon whom she represented had been called in to consult on the plaintiff by plaintiff’s treating gynecologist, who had performed a laparoscopic tubal ligation three days earlier. In addition to the malpractice claim raised against the gynecologist, the plaintiff claimed that the surgeon failed to diagnose a laceration to the small bowel at the time of his initial consult and that the alleged one day delay in diagnosis necessitated more expansive surgery to correct the defect, resulting in a prolonged and painful recovery, significant scarring, the development of abscesses and a small bowel obstruction due to post-surgical adhesions. Following an hour of deliberation, the jury returned a verdict in favor of both the gynecologist and the surgeon.
